4. SITE ACCESS TERMS AND CONDITIONS

These terms and conditions apply to users of the Sussan website ("the Site"). By using this Site, you accept and agree to these terms. Sussan VIP members are also subject to the “VIP Membership Terms and Conditions�? (below).

Sussan reserves the right to change these terms at any time, please check these terms at regular intervals for any changes. Continued use of the Site following any change to these terms will be deemed acceptance of those changes.

4.1 Information Collected on the Site

Each time someone visits this Site, we may collect the following information:

- The number of users who visit
- The date and time of users
- The number of pages viewed
- The pages and length of time viewed
- How users navigate the Site

No attempts are made to identify individuals browsing the Site. The data captured is used so that Sussan can accurately evaluate the content of the Site and make improvements.

4.2 Ownership of materials on the Site

Unless otherwise indicated, Sussan owns all copyright in the material on the Site. All registered or unregistered trademarks used on the Site are the property of their respective owners.

All information, material, text, graphics, logos, trademarks and other material (collectively referred to as Contents) on this Site are the property of Sussan and such Contents are protected under Australian laws and through international treaties.

Use of the Site will not confer any intellectual property rights in the Contents, or any goodwill or reputation associated with the Content. All rights are reserved.

4.3 Use of this Site

When you access the Site, you agree that you do so on the following conditions:

- You must not access or attempt to access any part of the Site which is not designated for access by your password;
- You must not use the Site or any of the material contained in it for any purpose which is unlawful, prohibited under these Terms, or which violates any right (including copyright) of Sussan or any third party;

From time to time, the Site may contain links to web sites operated by third parties. The inclusion of any link does not imply any endorsement of the linked web site by Sussan. Sussan is not responsible for the contents of any linked web site or any hyperlink contained in the linked web site.

Sussan does not warrant the correctness, accuracy, timeliness, legality or reliability of any third party web site, including the contents of any link framed by this Site. Your decision to link to a third party website is entirely at your own risk.

4.5 Privacy

VIP Statement on Privacy will also apply to VIP members' use of this Site. Although Sussan has implemented security measures in relation to information uploaded to the Site, you acknowledge that the internet can be inherently insecure and that Sussan will not be responsible for any breach of security or unintended loss or disclosure of information in relation to the Site.

4.6 Information and services at the Site

Sussan updates the Site regularly, however Sussan makes no representation as to the accuracy, currency or completeness of any information or services at the Site. All information and services are provided on the basis that you undertake the responsibility for assessing at your own risk.

All information and services at the Site are provided on an "as is" basis. To the fullest extent permitted by the applicable law, Sussan excludes all terms, conditions and representations, express or implied.

4.7 Indemnity

Sussan is not liable for any damages whatsoever including any special, indirect or consequential damages resulting from loss of use, data or profits, whether in an action in contract, negligence or other tort, arising out of or in connection with access to this Site or the information contained in it. Sussan does not warrant that the Site will be uninterrupted or error-free.

You should seek independent advice before acting on any material or information contained in this Site or any link to a third party web site and you must not provide any warranties to third parties in relation to the contents or performance of the Site.

VIP members must maintain the confidentiality of your Sussan VIP membership number and password. You are entirely responsible for any and all actualities which occur in relation to your VIP points balance via the Site. You hereby indemnify Sussan from any liability or expense arising from use or misuse of the Site by you or in relation to your points balance, including in relation to any communication (including but not limited to data, images, video, text and/or sound) which you upload to the Site. You agree to notify Sussan immediately of any unauthorised transaction in relation to your VIP points balance.

4.8 Security

When using the World Wide Web, the internet or third party networks or facilities, you are using networks, facilities and services that are beyond the control of Sussan. You assume all risk and liability of your use of the World Wide Web, the internet or any such third party networks, including any access to the Site via such media.

4.9 Outages

Sussan reserves the right to cease, interrupt or withdraw your access to the Site for any reason, including without limitation, for upgrades and maintenance of the Site.

4.10 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, it may be severed and will not affect the remainder of the agreement, which will continue in full force and effect and these Terms will be deemed amended to replace, to the extent legally permitted, the rights and obligations contained in the invalid, illegal, or unenforceable provision. The invalidity, illegality, or unenforceability of any provision of these Terms will not constitute failure of consideration.

4.11 Jurisdiction

These Terms will be governed by the Laws of Victoria, Australia and you submit to the non-exclusive jurisdiction of the courts of that jurisdiction and any courts which may hear appeals from those courts in respect of any proceedings in connection with these Terms or the Site. You are responsible for compliance with all laws and regulations applicable to you in your location.

5. VIP PROGRAM TERMS & CONDITIONS

These Terms and Conditions form the basis of the Sussan VIP program and are effective 1st June, 2004.

5.1 Membership

5.1.1 Only individuals may be members of the VIP program. Membership is free. A person who is invited to become a member can apply in the ways provided by Sussan; and will be bound by these Terms and Conditions, as varied from time to time, upon acceptance by Sussan (for written application forms) or upon the member using their VIP member card or entering into any transaction that would, give rise to VIP points. These Terms and conditions will apply to all VIP transactions, whether before or after these Terms and Conditions become binding.
5.1.2 Sussan may refuse any application.
5.1.3 Points will not be credited until these Terms and Conditions have become binding.
5.1.4 VIP member cards are issued on the basis of one card per individual.
5.1.5 VIP membership will become effective on the date of card issue and points will be credited from this date. Purchases made prior to joining the VIP Program are not eligible to receive points.
5.1.6 A member must notify Sussan immediately of any change of address or of a lost or stolen membership card. Sussan is not liable for any delay in replacing a membership card or for any unauthorised use of a membership card.
5.1.7 Sussan may terminate a membership in the VIP program without notice for any reason including, without limitation, if the member:

- Fails to comply with these membership Terms and Conditions;
- Abuses any privilege accorded to the member under the VIP program;
- Supplies any misleading information or make any misrepresentations to Sussan in connection with the VIP program; or
- If the member does not use their membership card for a continuous period of 12 months or dies or becomes bankrupt .

5.1.8 A member may terminate their membership in the VIP program at any time by giving written notice to Sussan. Upon receipt of such notice the members contact details will be noted on the Sussan VIP program database as closed.
5.1.9 Membership cards are not credit or charge cards, are not transferable, and remain the property of Sussan.
5.1.10 Membership cards must be presented for all transactions, including; purchases, returns and lay-by deposits.
5.1.11 Any tax, liability, or duty arising from a member’s participation in the VIP program is the responsibility of the member.

5.2 Earning points

5.2.1 Points will be credited to a members account for purchases by the member of qualifying goods or services from Sussan. Points may also be credited to a members account for promotional and incentive programs offered by Sussan from time to time.
5.2.2 In order to obtain points, a member must notify Sussan before the transaction concludes that the purchase is a VIP one and must present their membership card at point of sale.
5.2.3 When making a VIP program transaction the member will earn 1 (one) VIP point for every dollar spent and the points will be calculated daily.
5.2.4 VIP points can be earned for lay-by deposits and subsequent payments.
5.2.5 VIP points cannot be earned from the redemption of Sussan credit notes and gift vouchers.
5.2.6 Points and the rights they confer cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these Terms and Conditions. Points have no cash or monetary value.

5.3 Claiming an award – VIP voucher

5.3.1 Members must earn a total of 500 VIP points within a rolling 12 month period to be eligible for a ward. 500 VIP points equal 1 (one) $50 VIP voucher. The voucher will automatically be sent via mail with 500 points being deducted from your point balance, deducting the oldest points first.
5.3.2 VIP Vouchers will only be made available in the name of the member.
5.3.3 VIP Vouchers are offered at the absolute discretion of Sussan and Sussan reserves the right to withdraw, cancel, vary or in any way change at any time without notice any of the vouchers offered or advertised as available.
5.3.4 Where necessary VIP vouchers will be posted or delivered, to the current address of the member shown in Sussan records. Sussan is not liable for any loss, theft or damage to any award in the course of post or delivery. If Sussan agrees to replace a lost or stolen VIP voucher, the member shall comply with such conditions as Sussan imposes.
5.3.5 If a VIP voucher is lost or stolen, Sussan may issue a substitute voucher upon receiving satisfactory evidence regarding the circumstances under which the voucher was lost or stolen. In this instance, the member must contact Sussan in writing and supply a statutory declaration outlining their circumstance.
5.3.6 VIP vouchers are non-transferable and cannot be exchanged for gift cards or credit notes.
5.3.7 VIP vouchers cannot be redeemed at our online store.

5.4 Other deductions of points

5.4.1 In addition to deductions for awards claimed, Sussan will deduct from the points balance in a member's account any points credited in error and any points relating to a transaction which is cancelled or reversed or where a refund is given.
5.4.2 Any points which are not used by the member in claiming an award within 12 months after the points were credited to that account will expire and will be deducted from the points balance in a member's account.

5.5 General

5.5.1 Sussan reserves the right to make any changes at any time without prior notice and at Sussan’s absolute discretion, to these Terms and Conditions. Susan will attempt to notify members of any changes but shall not be liable in any way for failure to do so.
5.5.2 The Policy on information Privacy issued by Sussan forms part of these Terms and Conditions, but shall prevail over these Terms and Conditions if they are inconsistent in any respect.
5.5.3 Sussan also reserves the right to make any changes at any time without prior notice and in their absolute discretion to the goods and services which are qualifying Sussan goods and services and the number of points which members will receive as a result of acquiring such goods and services.
5.5.4 Sussan reserves the right to suspend or terminate the Sussan VIP program at any time without prior notice. Sussan will not be liable for the suspension or termination of the Sussan VIP program on any account whatsoever including (without limitation) for any points balance in a members account at the time of suspension or termination.
5.5.5 A notice shall be deemed to be given by Sussan to a member if it is sent to the postal or email address of the member appearing in the Sussan VIP program database.
5.5.6 In these Terms and Conditions “Sussan�? means Sussan Corporation. (ABN 79 772 682 378) or its authorised representatives, and “Sussan VIP program�? means those arrangements by which a member collects points by purchasing qualifying goods and services and thereby qualifies for awards under these Terms and Conditions.

6. VIP POLICY ON INFORMATION PRIVACY

At Sussan, we respect the privacy of your personal information in our care and this commitment is demonstrated in our Statement on Information Privacy.

Under no circumstances will information be sold or made available to marketing agencies or similar parties not involved with the Sussan VIP program. Members have the right to opt out of mailings. They can access personal information by writing to:

6.1 Members' rights

Sussan Corporation as manager of the Sussan VIP program respects and upholds the rights of members to privacy protection. The provisions of this Statement are evidence of Sussan's commitment to that protection. This Statement applies to all personal information held in the Sussan VIP program database.

Refer section 4.5 of the Sussan Site Access Terms and Conditions. Words and phrases defined in the Sussan VIP program Terms and Conditions have the same meaning when used in this Statement.

6.2 Information Collection

6.2.1 Sussan will, at all times, collect personal information in a fair and lawful manner. Sussan VIP program Terms and Conditions and the Statement on Information Privacy which detail the purposes for collection of information will be made available to prospective members at the time of their membership application.
6.2.2 The Sussan VIP program database comprises the following personal member information, held securely by Sussan:

- Full name, address & telephone number(s), e-mail address
- Date of birth
- Password
- Transaction details associated with the collection of Sussan points
- Points collected and awards provided

Members' signatures/authorities are also collected by Sussan

6.3 Information – purpose & usage

6.3.1 Personal member information including your e-mail address will be used for two primary purposes.

First, it will be used to ensure the proper functioning of the Sussan VIP program. Secondly, and subject to the restrictions set out in paragraph it will be used for the marketing, planning, product development and research requirements of Sussan.

6.3.2 Sussan will not use or disclose or permit the use or disclosure of personal member information that could be used to identify an individual member in any circumstances except:

a) To ensure the proper functioning of the Sussan VIP program in relation to the member in question (for example, to confirm membership and acceptance of the Terms and Conditions, to communicate points earned, to seek the member's views on the operation of the Sussan VIP program in order to improve member service, to communicate promotional offers and special events and to identify the member when rewards are made) and for these purposes personal member information will only be disclosed to Sussan or an agent retained by Sussan under conditions of confidentiality;

Examples of the agents referred to in paragraph 6.3.2(a) are data processing and data analysis agents, printing contractors and the Sussan VIP Customer Support Team. Information will only be provided to these agents to the extent necessary to enable them to undertake their contracted roles in the operation of the Sussan VIP program.

6.3.3 Sussan undertakes to give proper and responsible consideration to privacy issues associated with the introduction of new marketing devices or technology.
6.3.4 On termination of membership, the member's contact details will be noted as closed.
6.3.5 Due to the importance of your privacy, our Statement on Information Privacy will be reviewed and monitored regularly. A copy is available by contacting the Privacy Officer.
6.3.6 If you are concerned with the way Sussan has handled your personal information, please contact our Privacy Officer with your complaint. We will make available to you a privacy complaint form, which you will be required to complete and return to us. This will ensure the prompt investigation of your complaint. If we have not handled your personal information in an appropriate way we will take steps to remedy your concerns promptly.

6.4 Members' right to opt out

From time to time, promotional offers and special events will be communicated to members. Members have the right to opt out of these additional communications and can do so by requesting this in writing to Sussan, email is also acceptable.

6.5 Security safeguards

6.5.1 Sussan undertakes to take reasonable steps necessary to ensure that member information is secure from any unauthorised access or disclosure.
6.5.2 Sussan assumes no responsibility for the information practices of third-party sites where a user is able to access their sites through ours, and encourages users to review each site's privacy Statement before disclosing any personally identifiable information.

6.6 Cookies and Log Files

Cookies may be used on some areas of our website. A cookie is a small file placed on a user's hard drive which tracks website navigation. For example, a cookie can be used to store registration information so that a user does not need to re-enter it on subsequent visits. If you are concerned about cookies, most browsers have an option which permits users to refuse a cookie. A user can refuse a cookie and still fully navigate our website. In order to collect user statistics we may anonymously log information, and identify categories of users by items such as domains and browser types.

6.7 Openness

6.7.1 The Sussan Statement on Information Privacy will be made available at or prior to application for membership or otherwise on request.
6.7.2 Members may request access to their personal member information on the Sussan VIP program database. Such requests must be in writing to Sussan. A fee for reasonable costs incurred may be charged in responding to these written requests, such a fee being made known to the member before it is incurred.

6.7.3 Members have the right to update any incorrect contact details.

7. COMPETITION ENTRY AND NEWSLETTER SUBSCRIPTION

Entry constitutes entrants' consent to their personal information [collected in this entry form] to be used by Sussan for compiling its customer database and for marketing purposes. Sussan may provide you with joint promotional offers in conjunction with other third parties. These promotional offers are developed in line with your needs, but should you not wish to receive this information, please choose to "unsubscribe" at the base of a Sussan email newsletter.
