Terms & Conditions of Sussan Gift-with-Purchase
1. Information on how to enter the Sussan gift with purchase promotion (“Promotion”) forms part of these Terms and Conditions. These Terms and Conditions will prevail to the extent of any inconsistency between these Terms and Conditions and any other published material. By participating in the Promotion you accept these Terms and Conditions. Purchases not made in accordance with these Terms and Conditions will not be eligible for the Promotion. 

2. The promoter is Sussan Corporation (Aust) Pty Ltd, registered office: 11 Palmer Parade Cremorne Victoria 3121 Australia, ABN 79 772 682 378 (“The Promoter”).

3. This Promotion commences at 9.00am AEST on 8 March 2024 and ends at 11.59pm AEST on 8 March 2024 (the ‘”Promotion Period”). The Promoter may terminate or alter the Promotion at any time prior to the commencement of the Promotion Period. 

4. The gift is a Sussan scarf in one (1) of five (5) patterns, valued at AUD $29.95 (“Gift”). 

5. The Promotion is available to all Australian residents who satisfy the eligibility requirements while stocks of the Gift last. Employees of the Promoter are ineligible for the Promotion where an employee discount is applied to what would otherwise be an Eligible Purchase. If an employee makes an Eligible Purchase without an employee discount they will be eligible to receive the Gift. 

6. A customer must be signed up as a Sussan VIP, signed into their account and make an eligible purchase within the Promotion Period to receive the Gift. An eligible purchase is one single purchase transaction of at least AUD $100.00 on the Sussan website, www.sussan.com.au (“Website”), in which the purchase is completed during the Promotion Period (“Eligible Purchase”). Each Eligible Purchase will be calculated based on the gross amount spent in a single order, after all discounts (including vouchers and promotions) are applied, with exception of any VIP $50 rewards issued to qualifying VIP customers. 

7. Delivery of the Gift may be shipped together or separately with the Eligible Purchase subject to the availability. The Gift will only be delivered to a customer with an Eligible Purchase while there is stock available. The Promoter will not be liable for any changes to the value or make up of the Gift. The Gift is not transferable, exchangeable or refundable and cannot be taken as cash or any other gift. If any item(s) of the Eligible Purchase are returned the customer may be liable to return the Gift to the Promoter. 9. A customer is only eligible to receive one Gift for an Eligible Purchase for the duration of the Promotion. If multiple Eligible Purchases are made during the Promotion a customer will only be eligible to receive one Gift. 10. Purchases not made in accordance with these Terms and Conditions or received after the Promotion ends will not be eligible. The Promoter may at is absolute discretion declare a purchase to be ineligible if the customer makes a purchase that is not in accordance with these Terms and Conditions. 

11. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) exclude all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any as a result of or in relation to this Promotion. 

12. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter in its sole discretion can take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to any applicable State and Federal laws and regulations. 

13. The Website may not be available for access from time to time during the Promotion Period and all access to the Website is at the individual’s risk. Neither the Promoter nor any related entity of the Promoter will be responsible for any problems or technical malfunction of any computer online systems, servers or providers, computer equipment, software, failure of any order to be received by the Promoter on account of technical problems or traffic congestion on the internet. 

14. Any costs associated with accessing the Promoter’s website is the entrant’s responsibility and is dependent on the internet service provider used. 

SUSSAN TIKTOK GIVEAWAY 
1. Information on how to enter and prizes form part of these terms and conditions.  Entry into this competition is deemed to be acceptance of these terms and conditions.   
2. The competition (“Competition”) is open only to residents of Australia, who are 18 years of age or older as of the beginning of the Competition period, and who are not an employee of or domiciled with an employee of the Promoter or any of their affiliated companies. 
3. The host (“Promoter”) of this competition is Sussan ABN 79 772 682 378. 
4. This Competition commences on 25 February 2024 at 5:00pm AEDT and ends on 3 March 2024 at 11:59pm AEDT (“Competition Period”). 
5. To enter the Competition, entrants must follow @sussanfashion on TikTok during the Competition Period.  This contest is not sponsored, endorsed or administered by, or associated with TikTok. The Promoter takes no responsibility for any entries that are late, lost, misdirected or not received by the Promoter within the competition period.  All entries become the property of the Promoter. 
6. The Promoter will select one valid entry at random as the winner at 10:00am, on 4 March 2024.  The draw will take place at approximately 10:00am on 4 March 2024. The winner will be notified via TikTok direct message from @sussanfashion only (using account / address registered with the Promoter).  The winners name will be published on the Promoter website.   
7. The Promoter decision is final and no further correspondence will be entered into.   
8. There is one (1) prize to be won.  The prize consists of a selection of pieces from our new March collection up to value of $1,000  (“The Prize”). 
9. The Prize must be accepted as awarded and is not transferrable or redeemable for cash.  Any unused portions or elements of the Prize are forfeited. Prizes cannot be refunded.  
10. The total prize pool value is AUD$1,000.  The promoter accepts no responsibility for any variations in the Prize value.  If any elements of the prize are not available due to unforeseen circumstances, the Promoter may provide a substitute prize of equal or greater value.  The Prize will be distributed or collection will be arranged for the Winner within 1 month after the acceptance of the Prize / Prize draw date.   
11. Any travel required for the prize is at the cost of the winner and the Promoter takes no responsibility for any loss or damages.  If the winner is required to cancel elements of the Prize, the Winner is forfeiting their right to the Prize. 
12. If the Prize is unclaimed by 12:00pm AEDT on 5 March 2024, a further draw will take place to select a replacement winner. The replacement winner will be notified by TikTok direct message on that date. The replacement winner must claim the Prize by responding to the Promoter via email by 12:00pm AEST on 6 March 2024. If the replacement winner does claim their prize, competition will be void. The winner’s name will also be announced on the promoter websites on or around the same date.

14. The use of pen names, or any robotic, automatic, programmed or any other entry methods not authorized by these terms and conditions is not permitted. Entries that are incomplete, illegible, damaged, contain incorrect information or do not comply with these terms and conditions will be disqualified.
