1. Definition

      In these VIP Program Terms:

• Capitalised terms have the meanings given to them in the Website Terms of Use; and
• Sussan VIP Program means the arrangements by which an individual collects VIP points by purchasing qualifying goods and services from Sussan and qualifies for awards, as further described in these VIP Program Terms and on the Website.

2. Membership
    
   
   • Only individuals may be members of the Sussan VIP Program. Membership is free.  
   • A person who is invited to become a member of the Sussan VIP Program can apply in the ways provided by Sussan from time to time, and will be bound by these VIP Program Terms (as varied from time to time) upon:
     
     
     • acceptance of that application by Sussan (for written application forms); or
     • the member using their VIP member card to enter into a transaction that would earn VIP points (a VIP transaction).
   • Applicants for Sussan VIP Program membership must provide Sussan with accurate, complete and up-to-date information. Sussan may, in its sole discretion, refuse any application for membership of the Sussan VIP Program.
   • VIP membership will become effective on the date on which Sussan issues a VIP member card to the applicant. VIP points will only be credited from this date.  Purchases made prior to joining the Sussan VIP program are not eligible to receive VIP points.
   • VIP member cards are issued on the basis of one card per individual.
   • Once an individual has joined the Sussan VIP Program (a member), the member must notify Sussan promptly of any change of details (for example, the member's mailing address) or of a lost or stolen membership card. Sussan is not liable for any delay in replacing a membership card or for any unauthorised use of a member's membership card.
   • Sussan may terminate the member's participation in the Sussan VIP Program without notice for any reason including, without limitation, if the member:
      
     • fails to comply with these VIP Program Terms;
     • abuses any privilege accorded to the member under the Sussan VIP Program;
     • supplies any misleading information or makes any misrepresentations to Sussan in connection with the Sussan VIP Program; or
     • does not use their membership card for a continuous period of 12 months, dies, or becomes bankrupt.
   • A member may terminate their Sussan VIP Program membership at any time by giving written notice to Sussan. Upon receipt of that notice, the member's account will be noted on the Sussan VIP Program database as closed.
   • Membership cards are not credit or charge cards and are not transferable.
   • Membership cards must be presented for all transactions, including purchases, returns and layby deposits.
   • Any tax, liability, or duty arising from a member's participation in the Sussan VIP Program will be borne solely by the member.
     
     
3. Earning VIP points
    
   • VIP points will be credited to a member's account for purchases by the member of qualifying goods or services from Sussan. VIP points may also be credited to a member's account for promotional and incentive programs offered by Sussan from time to time.
   • In order to earn VIP points, a member must notify Sussan before the transaction concludes that the purchase is a VIP transaction and must present their membership card at the point of sale.
   • When making a VIP transaction the member will earn 1 (one) VIP point for every dollar spent. VIP points will be calculated daily.
   • VIP points earned for layby purchases will be awarded after the final layby payment.
   • VIP points cannot be earned from the redemption of Sussan credit notes and gift vouchers.
   • VIP points and the rights they confer cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these VIP Program Terms. VIP points have no cash or monetary value.
     
     
4. Claiming an award – VIP voucher
    
   • Members that earn a total of 500 VIP points in a rolling 12 month period are eligible to receive a $50 VIP Voucher.
   • Eligible members who have subscribed to receive emails from Sussan will receive the VIP Voucher in digital form by email. The digital voucher will be sent to the email address listed on the member’s account.
   • Eligible members who have not subscribed to receive emails from Sussan will receive a physical VIP Voucher by post. The physical voucher will be sent to the postal address listed on the member’s account.
   • Upon issue, 500 VIP points will be deducted from the member’s VIP points balance. The oldest VIP points will be deducted first.
   • The VIP Voucher expires 3 months from the date of issue and can be used in-store or online.
   • The VIP Voucher can only be redeemed in a single transaction. If there is any balance remaining on the voucher after the transaction, that amount will be forfeited and cannot be redeemed as cash or future credit.
   • The VIP Voucher cannot be used in conjunction with any other offer, promotion or lay-by.
   • The VIP Voucher is non-transferable and cannot be redeemed for cash, gift cards or credit notes.
   • If an item is purchased in-store with a VIP Voucher and the member changes their mind, a refund will be provided for any amount that is paid in excess of the VIP Voucher amount and the member may be offered an exchange up to the value of the VIP Voucher.
   • If an item that is purchased with a VIP Voucher does not comply with the guarantees under the Australian Consumer Law, Sussan will comply with its obligations under the Australian Consumer Law to provide either a repair, replacement or refund of the purchase price. If a refund is provided, the value of the VIP Voucher will be restored.
   • Sussan is not liable for any loss, theft or damage to the VIP Voucher that occurs in the course of delivery. In the event of loss, theft or damage, Sussan may at its discretion issue a substitute voucher upon receipt of satisfactory evidence regarding the circumstances in which the VIP Voucher was lost, stolen or damaged. To request a substitute voucher, the member must contact Sussan in writing and supply a statutory declaration outlining the relevant circumstances relating to the loss, theft or damage.
   • Sussan reserves the right to vary these terms and conditions. Any such variation will not apply retrospectively.
     
     
5. VIP Welcome Voucher
    
   • Sussan Group will send via email a $20 Welcome Voucher to new members of the online VIP Program who have subscribed to receive email updates from Sussan. The Welcome Voucher expires one month from the date of issue. It is non-transferable and cannot be redeemed for cash. Sussan Group reserves the right to withdraw, cancel or vary the vouchers offered on its site without notice. Please note, this may take up to 48 hours to be delivered to the nominated email.
     
     
6. Other deductions of VIP points
   
   
   • In addition to deductions for awards claimed, Sussan will deduct from the VIP points balance in a member’s account any VIP points credited in error and any VIP points relating to a VIP transaction which is cancelled or reversed or where a refund is given.
   • Any VIP points which are not used by the member to claim an award within 12 months after the VIP points were credited to that account will expire and will be deducted from the VIP points balance in the member’s account.
     
     
7. Changes, suspension and termination
   
   
   • Sussan reserves the right, in its sole discretion, to make any changes at any time without prior notice to the goods and services which are qualifying Sussan goods and services for the purposes of earning VIP points, and the number of VIP points which members will receive as a result of acquiring such goods and services.
   • Sussan reserves the right to suspend or terminate the Sussan VIP program at any time without prior notice. Sussan will not be liable to any member for any loss or damage suffered or incurred by a member arising out of or in connection with the suspension or termination of the Sussan VIP program including (without limitation) the expiry of any VIP points in a member's account at the time of suspension or termination.
8. VIP Promotional Email Codes
   • All points must be collected within a 12 month period.
   • Most VIP vouchers can be used both in-store & online on full price and sale items, however please check the T&Cs on the email sent to you. When shopping online, VIP users must be logged into VIP account in order to redeem. It is non-transferable and cannot be redeemed for cash. Sussan Group reserves the right to withdraw, cancel or vary the vouchers offered on its site without notice. 
   • $20 VIP Voucher are valid one month after issue date. These include Birthday Vouchers & Anniverary Vouchers. These vouchers cannot be used in conjunction with any other promotional vouchers, used to purchase gift cards or exchanged for cash or refund. Lay-bys also excluded. You may need to allow 30 minutes to activate your voucher.
   • $25 VIP Voucher can only be used online. Vouchers cannot be used in conjunction with any other promotional vouchers, used to purchase gift cards or exchanged for cash or refund. Lay-bys also excluded. You may need to allow 30 minutes to activate your voucher.
   • 500 Points - $50 VIP Voucher are valid one month after issue date. Vouchers cannot be used in conjunction with any other promotional vouchers, used to purchase gift cards or exchanged for cash or refund. Lay-bys also excluded. You may need to allow 30 minutes to activate your voucher.
